Depends on how much 3% is in your case. If you e.g. have 100 visits a day, it means, that up to 3 potential customers are perhaps locked out.
Designing for usability and accessibility means, that your website might work, even if micros~1.oft or Netscape announce a new browser version. Yeah, that's really true. 3% can be a lot if you are working for a big company. And what's about systems like IRIX where there is no netscape 6 yet and the new versions of mozilla are really slow?
Suppose that your boss doesn't know much of programming, he's not going to accept that excuse. I've experienced it. On the other hand, a lot of users are going to think that that's your mistake and not a browser's error. Regards, Josef.
